WHERE'S THE BILL OF SALE?

We're waiting, Sam Cahnman. You said you'd have proof for us on Thursday of your sale of the vehicle that was found registered to you.. with drug paraphernalia in it. Today is Friday. Will we have it Monday?

Court documents back Cahnman on ownership of car

The Pawnee man who bought a car with Ward 5 Ald. Sam Cahnman's license plates on it was pulled over near the Qwest Inn in Springfield the day after the purchase, according to court documents.

The documentation supports assertions by Cahnman that he was not the owner of the car when it was found abandoned in a Springfield alley with drug paraphernalia inside on Oct. 20.
Meanwhile, a criminal investigation into the matter apparently is going nowhere. A police report has been referred to the state's attorney's office for review, but no action has been taken.

The officer who arranged to have the car towed sent the drug paraphernalia to the state crime lab to be examined for fingerprints, which is standard police procedure, but it is unlikely any usable prints will be found.

And a woman who twice complained to police about the car blocking the alley outside her home said Thursday that she had told an officer the man she saw trying to start the car at one point was not Cahnman.

The white 1990 Pontiac Grand Prix still had Cahnman's license plates on it at 4:19 a.m. Sept. 15, when a Springfield police officer pulled it over on Dirksen Parkway at Widetrack Drive.

The driver, Ian P. Thiel, 32, was ticketed for having no valid driver's license.

Thiel lives in rural Pawnee. He appears to be the person who bought the Grand Prix from Cahnman's mechanic, John "Jay" Yazell, on Sept. 14. A receipt for the purchase was made out to a John Thiel.

Two reporters went to Ian Thiel's house Thursday afternoon. When he answered the door, a reporter asked if he was John Thiel, to which he replied no, saying John Thiel was his deceased father. Newspaper archives show John Thiel died in April.

A reporter then asked the man if he had a white 1990 Pontiac Grand Prix, and he replied with a simple, "No." After a brief conversation, the man identified himself as "Ian" and the reporters left.

Cahnman on Friday said he had been told Ian also goes by the name of John Thiel Jr.

Yazell, who lives in Bath, went to Thiel's house Thursday - the same house where the reporters had been - to try to clear up some issues with the title on the Grand Prix, Cahnman said.

Meanwhile, the resident of a home at Fifth and Ash streets told reporters she had called police twice to complain that the Grand Prix was blocking the alley next to her house.

The car was parked just off Ash Street, at the end of an alley that runs north and south between Fifth and Sixth streets.

The woman parks behind her house and must use the alley to get to her parking spots

The woman first called the police department on the night of Oct. 17. She said an officer showed up and checked the license plate number. The officer told her the plates were registered to Cahnman and that police would give him a chance to retrieve the car before having it towed away.

Three days later, she said, the car was still blocking the alley. During that time, according to a police report, a witness reported seeing two men around the car.

Two witnesses described one of the men as tall, thin and white with reddish-brown hair and a "big nose" and wearing a baseball cap, glasses and jeans.

That description could generally describe Cahnman, but it also generally describes Thiel, according to the reporters' observations. The only difference was that Thiel had brown hair and a beard on Thursday.

About 1 p.m. Saturday, the woman called police again to complain about the Grand Prix. After a dispatcher was unable to reach Cahnman, the officer initiated arrangements to have the car towed.

Any time a car is towed on police order, officers are required to look though the interior and inventory everything inside. In the Grand Prix, the officer found a piece of a crack pipe and a baggie corner that appeared to have cocaine residue on it.

The discovery and the fact that Cahnman's license plates were on the vehicle caught the interest of police, but Cahnman said he had not seen the car in years.

The woman who complained about the car blocking the alley told reporters that she specifically told the second officer that the man she saw trying to start the car was not Cahnman, whose face she knew from seeing on television. That fact is not recorded in the police report.

Thiel has a criminal record in Sangamon County that includes burglary, forgery, possession of marijuana and drug paraphernalia, criminal damage to property, a DUI and some citations for driving with no insurance or driver's license.

Cahnman is a lawyer and former Sangamon County Board member who is in his first term as a Springfield alderman. He was listed as the suspect on the police report, which lists the offenses as possession of a controlled substance and drug paraphernalia. Police said it is standard procedure to list the registered owner as a suspect when no one is around a car containing contraband.

Yazell later told a reporter he had agreed to repair the car several years ago after the engine blew. But Yazell said the car was consistently unreliable and needed frequent repairs.

Cahnman and Yazell agreed that Yazell would place an ad in the Springfield Shopper to sell the car, but Cahnman said he couldn't find the title for the car and ordered a duplicate from the secretary of state's office.

A check performed by a newspaper reporter showed that the car has had three owners, not counting Thiel, that it has been registered in Greenfield, Pana, Thayer and Springfield through the years, and that a duplicate title was requested Sept. 7.

Before Yazell could place the ad, Thiel showed up inquiring about the car.

They finally agreed Thiel would trade Yazell a broken-down truck and $150 for the Grand Prix. Yazell made out two receipts, one for Thiel and one for himself.

The car was registered and insured by Cahnman even when it didn't run. All vehicles must be properly registered if they are parked on the street, which the Grand Prix sometimes was. And it was insured for the replacement value in case anything happened to it.

Yazell said he forgot to remove the license plates before Thiel drove off and never gave it another thought until he got a "screaming phone call" from Cahnman after the news broke earlier this week.

Cahnman on Friday would not say if he believes he is owed any kind of apology.

"I'll leave that up to whoever leaked this story and those folks who gave it undue publicity. That's their call. I think the story should be checked out first, rather than going with your first instinct, which is to bring down a public official," he said.

He said he intends to talk to lawmakers and secretary of state officials about the possibility of changing the law on title transfers. It is now up solely to a buyer to transfer a vehicle title.

"When this story first came out, I told reporters there was no story here because I know there was nothing to it," he said. "I was wrong. There is a very interesting story. It shows how careful you have to be when you're selling your car."

That some media people here in town seem so anxious to smear Cahnmans reputation. How sad that they made him appear guilty without knowing thw whole story. I wonder if they'll be as quick to vindicate Mr. Cahnman as they were to spread innuendo?

Time will tell wrote at 10/24/2007 6:34:55 AM

sounds fishy to me..dont cancel the insurance? dont take your plates?

Just Another Citizen wrote at 10/24/2007 6:43:55 AM

"A neighbor had complained about the car the night of Oct. 17." "Yazell said he had written two receipts for the sale, one for the buyer and one for himself. The receipt is dated Sept. 14 and written in red is that $150 was paid in full. " "Cahnman provided a copy of an auto insurance coverage summary that indicates he asked that the white Grand Prix be taken off his policy on the morning of Oct. 18" so why then, did Mr. Cahnmann wait until the day after the police first checked the car to drop the insurance on this vehicle? Also, if Mr. Yazell still has the "broke down truck", can't the owner be traced? Not to mention the fact that if there was a replacement title issued prior to the sale, there should be paperwork on that at the Secretary of State's office. things that make you go "HMMM, gotta wonder."

The only question that comes to mind is, why would you carry insurance on a car that "Cahnman said he hasn’t seen the car for years." ??????

were the license plates current? and if so, who paid for them? I know when I went to purchase plates earlier this month, I had to sign the application.

it makes sense to carry insurance on a vehicle up until the time it's sold. I think that one radio talkshow host has sensationalized this without fist having all the facts. Mr. Cahnman to me, seems to be the target of a smear campaign. I hope people will reserve judgment on this until all the facts are known and disregard all the innuendo.

She did nothing more than report what her sources told her. Isnt that what journalism is? Are we now supposed to wait until i jury comes in with a verdict before reporting there is a situation? The whole thing sounds funny. Why have the car insured an extra month after you dont own it? S.C. isnt joe blow off the street he is trained legal professional. A lawyer knows better. Same with a car dealer, he knows better than to leave plates on a car.

Just heard another local radio talkshow host interviewing Mr. Cahnman, or should I say, raking him over the coals. Why are some people so determined to make this in to a big deal? Why can't they just accept his explanation and the car dealers as the truth? Really seems like Mr. Cahnman has gotten on these peoples bad side for some reason or other. As for the female talk show host, her sources leaked her confidential information. Doesn't sound too ethical to me.

Not a Sam fan... wrote at 10/24/2007 8:26:13 AM

...but Sam is correct. A vehicle owner must maintain insurance on the car even if he/she doesn't drive the car. So that part of the story makes sense. However, it also does not make sense to keep the insurance active AFTER selling the vehicle.

Shame on the SJR wrote at 10/24/2007 9:03:31 AM

After reading this story, I am amazed that you allowed into print the expletives uttered by Mr. Yazell. I know they are common words into today's society, but I still find it appalling that you wouldn't eliminate them.

If I were Sam... wrote at 10/24/2007 9:10:33 AM

Why in the world would the SJ-R put the word "damn" in the story? SJ-R, please get a clue - and you recommend students read you papers in school? What is this a lesson in curse words?

Now that Alderman Cahnman has been cleared, maybe he can refocus on his commitment to enforce the anti-panhandling laws in the downtown area. It seems like the street people have been getting worse lately. Hop to it Sam and our city officials!

okay.... wrote at 10/24/2007 9:35:20 AM

Okay. My earlier comments didn't make it through. I'll try again. I'm willing to wait for the rest of the facts. Seems simple. If the car was sold, provide the name of the new owner. It seems strange that a guy who has been buying and selling cars for years as a business, would fail to remove plates from a car he sells on behalf of a prominent politician and atty. And the insurance was only cancelled after the car was found abandoned? Provide the name of the new owner.

ye gads wrote at 10/24/2007 9:47:02 AM

I can not believe some of these comments. First the car was sold on a Sunday and the insurance was dropped the following Wed. A couple of days is not that long. Then one has to carry insurance and keep valid tags on a car even if its not running because of junk vehicle ordinances and that the plates have to be valid for someone to test drive the car. It all makes one wonder if there is something in the water in Springpatch that kills common sense and logic. To those whining about the "curse" words...get over it. The wee replicants in Springpatch are exposed to much worse at school and you can bet 99% do not read much of anything much less the SJ-R.

IF wrote at 10/24/2007 9:49:04 AM

this is such a big deal (cocaine residue and part of a drug pipe), why haven't they mentioned the man who bought the car? Who is he, and has he been questioned? Sounds like much ado about nothing.

Chris wrote at 10/24/2007 9:50:57 AM

I never thought much of Sam, but he's been treated unfairly by the media in my opinion. This kind of thing could happen to anyone. To "Shame on the SJ-R" - the words used in the article are no less than you would find on any TV show, meeting the FCC's guidelines for decency. It's laughable to think someone could be "appalled" by such words.

Hmmm wrote at 10/24/2007 10:03:08 AM

The SJ-R should disclose just who, exactly, burned them on this smear story. Protecting a source is one thing, but a lying source with an obvious ax to grind should be outed.

Get off Sam's Back wrote at 10/24/2007 10:04:10 AM

When you have one or two vehicles insured, and in Sam's case maybe more, sometimes canceling insurance doesn't come right to your mind. He's a busy guy with a lot going on...I'm sure canceling his insurance wasn't his very first priority. I myself forgot to cancel my insurance on a car I traded off for 3 months. What's the big deal? Leave Sam alone!!! He's a good hard working man that works for the citizen's of Springfield!! But, I do have to point out that when news happens, EVERY reporter is going to go out there and do their job. If this were true and it were Sam's car...I'd want to know. Stop bashing people...Sam made an honest mistake...things happen...get off his back and the journalist back...they are all just doing their jobs!

I agree Candle -- it seems as though, especially recently, that the begging and dare I say harassing has gotten increasingly worse. If we want to create a welcoming environment in our downtown area for tourists and residents alike, the panhandling must be put to an end. Alderman Cahnman - take let's focus on actually enforcing city ordinances and moving our downtown area forward.

Get off the swear words -- we live in a society that is becoming increasingly intolerant of people gang banging, swearing and wearing their underwear out. It is the lack of dignity and self-respect that got us to where we arent today. The swearing and violence on TV is the source of the current downfall in youth. Gain some self-respect - those of us who respect others and ourselves have no need desire to curse.

hey keith wrote at 10/24/2007 11:29:39 AM

I have to take issue with "The swearing and violence on TV is the source of the current downfall in youth" I tend to believe it is more the lack of anyone holding the youth responsible for their actions. Too many people are more then willing to attribute bad acts to a bad childhood and therefore do not hold the individual responsible. You know.. poor baby its not their fault and all that drivel.

Mark Observed wrote at 10/24/2007 11:31:37 AM

He is an atorney and should know that signing a blank title is a felony. It is called an open title. Also there is something that just does not smell right here. You just don't cancel your insurance a month after the car is "sold". And the previous story was he gave the care to his mechanic. In that case when he signed the title heshould have signed it over to his mechanic. Now he says that the mechanic was to sell it and they were to split the proceeds. Which story are we to believe. Sounds like the mechanic is covering for Mr. Cahnman. I really don't think there is any illegality involved (except the open title) just incompetence. I certainly would not go to Mr. Cahnman for any legal advice after this incident.

Veteran wrote at 10/24/2007 12:18:52 PM

Sam made a mistake by not making sure the plates were removed. He trusted the guy selling the car for him. There is no story here and I would advise Sam that the radio host yesterday requested for him to take a drug test I would tell her no. Why should he subject himself to a drug test? Also I would advise him to stop talking to reporters who seem to think they have a breaking story that would make national news. This is a non story and should be over with.

Follow-up wrote at 10/24/2007 12:31:18 PM

I hope there will be a follow-up article about the person ro whom rhe car was sold. Wonder why no one's mentioned his name? Seems all the attention has been wrongly focused on Cahnman. If the cocaine residue and the part of a drug pipe are so important, find the man who bought the car and question him. Why the focus on Cahnman and not the person who bought the car? Sounds like a slanted story.

anonymous wrote at 10/24/2007 12:47:22 PM

Keith - your right The swearing and violence on TV is the source of the current downfall in youth now that you've made us aware of it we'll fix it. We'll go back to the way things were in the 50s, we'll all dress the same, mom will stay at home and dad will go to work at the plant, dad will come home and we'll all site around the table and have dinner....Wake up....that's not going to happen....The parents, single or married have to take some responsiblity for their kids....teach them right from wrong....talk to them be involed in their lives....

Why wrote at 10/24/2007 1:18:43 PM

would you carry insurance on a car that was basically worthless? The car is 17 years old. Wouldn't you just "junk it?" He said he hasn't seen the car in years----again why would you carry insurance on it? So, Cahnman made $150 on it. How much did he pay for insurance over the last few years? That is what is curious.

To: Anonymous wrote at 10/24/2007 1:42:29 PM

The acceptance of swearing and disrespecting others, that was my point -- its really simple, not complicated. No values. The parents and the kids have to take responsibility - that was my point in the frst place. Im sorry your not the sharpest pen in the package. Back to the 50's? Get real.

oddball wrote at 10/24/2007 1:44:31 PM

I think any rational person would read this article and think that Mr. Cahnman had some bad luck. Its not like they were guilty of anything except not canceling his insurance, and the other guy for not removing the plates (big deal they won't be the first or last to do this). As for curse words "damn" is not one of the 7 deadly ones that the FCC is against. Also I am going increasingly intolerant of people who have it seems a hostile intolerance to harmless words. Is there not something more productive you can do beside berate a paper over something so minuscule?

IF wrote at 10/24/2007 1:45:39 PM

you're trying to sell a car wouldn't you have to insurance on it to cover anyone who might test drive the car? Sometimes things just get overlooked. My husband and I pay car insurance once yearly and don't even think about it the rest of the year. I really wish they would give us more info on the person who actually owns the car. Seems to me that he's the REAL story. But I guess he doesn't have the name recognition of Sam.

Ashamed wrote at 10/24/2007 1:52:35 PM

I think this is not anything more than a smear job. It is also obvious that some of the media, a female radio host from 3-6, is out to get Sam for some reason. I am not in his ward, but I think Sam has tried his best to help this city. The radio host needs to defend herself if she wants me to listen anymore.

Name the source wrote at 10/24/2007 1:52:50 PM

How did the SJ-R find out about this story? If the paper (or a talk show host?) is being used as a tool to trash Cahnman then readers have a right to know the source. I think there are a whole lot of articles where the reader would be better informed if they knew where the story was really coming from.

TO: Why wrote at 10/24/2007 1:54:05 PM

While Mr. Cahnman may not have seen the car for years, he was still the legal titleholder and, as such, required to carry liability insurance on the vehicle. What's so hard to understand about that?

To TO: Why wrote at 10/24/2007 2:01:33 PM

If the car sits he does not have to have insurance on it. I had a vehicle that I was doing work on and had no insurance on it. As long as it isn't being driven on the streets, you don't have to have insurance. If the car is being driven then whoever owns the title is required to have the states minimum insurance coverage.

to ye gads wrote at 10/24/2007 2:04:31 PM

The receipt was dated Sept. 14th and the insurance wasn't dropped until Oct. 18th, more than a couple days -- Plus, there is no mention of the plates being expired. Did Cahnman really pay $78 a year to register the car that he had not seen for years to ultimately sell it for half of $150? It doesn't make sense. Also, if the registration was current, how did the sticker get from Sam's mailbox to the car's rear plate? So many questions.

To "Ashamed" wrote at 10/24/2007 2:05:31 PM

I agree with you wholeheartedly. Will be interesting to hear if the radio host mentions it today. If she has such a good "source", maybe they can find out who bought the car and she can do a story on him. She owes Sam an apology for the browbeating.

Maybe you have become too accustomed to hearing and using them everyday to let it bother you. Some of us have too much respect for ourselves and others to use such language, no matter how "common" it is. And yes, part of it is due to the fact that you hear these things on TV. "If the car sits he does not have to have insurance on it." If it has valid plates on it, it must have insurance, whether driven or not, if not your plates will be suspended for a mandatory insurance violation. I do believe that insurance companies are now required to report you canceling a policy to the SOS, so if you drop it your plates will be pulled.

To To:To TO: Why wrote at 10/24/2007 4:13:33 PM

Not if it is on private property and not driven. I had a valid sticker and didn't have insurance on it and it was no big deal. Plus I drove a vehicle with a valid sticker for almost a year and nothing was ever done. I just went in and got my sticker for the new year. Do you know how many vehicles are sitting in yards and garages being fixed with no insurance?? Too many for the police to worry about.
